Terms & Conditions

To Exceed, LLC · Last Updated

Welcome to the To Exceed website. These Terms & Conditions explain the basic rules for using our website, contacting us, booking a meeting, requesting a free consultation, and using or viewing our content.

By using this website, you agree to these Terms & Conditions. If you do not agree, please do not use the website.

2. Website Content Is Informational

The information on this website is provided for general business and marketing information.

Website content, blog posts, case studies, videos, podcast materials, examples, audits, consultation comments, marketing recommendations, and other materials are informational only.

Nothing on this website guarantees a specific result.

Marketing performance depends on many factors, including:

  • Market conditions;
  • Driver availability;
  • Recruiting process;
  • Ad budget;
  • Competition;
  • Location;
  • Offer quality;
  • Landing-page quality;
  • Recruiter responsiveness;
  • Tracking accuracy;
  • Client follow-through;
  • Platform rules and algorithm changes.

We aim to provide useful, practical, straight-talking recommendations. But no website, audit, consultation, or strategy comment should be treated as a promise that your company will achieve a specific cost per lead, cost per hire, lead volume, hiring result, revenue increase, or advertising outcome.

3. Free Consultation Terms

To Exceed may offer a free consultation, free audit, free performance review, or similar introductory service.

The purpose of the free consultation is to provide useful feedback and also determine whether To Exceed may be able to help your company. We make a good faith effort to identify practical changes that may help improve cost per lead, lead quality, tracking, recruiting performance, ad efficiency, or other business concerns, strategies that you can implement without any obligation to hire or work with To Exceed.

As part of the consultation, To Exceed may review:

  • Your company website;
  • Public-facing landing pages;
  • Public-facing advertisements;
  • Public social media pages;
  • Public search results;
  • Publicly available business information;
  • Screenshots or reports you choose to provide;
  • Information you discuss during the consultation.

A free consultation is not a guarantee of results. It also does not create a client relationship unless both parties separately agree to work together.

If you are not interested in contracting with To Exceed after the consultation, that’s perfectly fine. We may follow up later to check in, answer questions, or see whether your needs have changed. We strive to be reasonable in follow-up communication, not engaging in harassment or spam unless it’s the Python singalong variety.

You may ask us to stop follow-up communications at any time.

4. No Professional Legal, Financial, or Employment Advice

To Exceed provides marketing and business consulting services. We are not acting as your legal counsel, financial advisor, accountant, compliance officer, or HR department.

Any comments about marketing claims, advertising practices, privacy policies, hiring funnels, recruiting workflows, or lead follow-up should be treated as business and marketing discussion unless we specifically state otherwise in a signed agreement.

You are responsible for obtaining legal, financial, tax, HR, or compliance advice from qualified professionals where needed.

5. Contact Forms and Communications

When you submit a form, book a meeting, request a consultation, or contact To Exceed, you agree that we may contact you about your inquiry and our services.

We may contact you by:

  • Phone;
  • Email;
  • Text message;
  • Other contact methods you provide or that are publicly available for your business.

Message and data rates may apply to text messages. You may generally opt out of text messages by replying “STOP.”

You may ask us to stop marketing follow-up by emailing sales@toexceed.com.

6. Do Not Submit Sensitive Information Through Ordinary Forms

Our website forms are intended for ordinary business contact information.

Do not submit:

  • Passwords;
  • Login credentials;
  • Confidential vendor contracts;
  • Private financial documents;
  • Sensitive business records;
  • Protected personal information;
  • Information you are not authorized to share.

If confidential or sensitive information needs to be discussed, that should happen through a more appropriate consultation, onboarding, or client-service process.

7. Calls and Recordings

Some calls with To Exceed may be recorded. When recording is used, it will be disclosed, and participation in a recorded call is voluntary.

If you do not want to participate in a recorded call, you may verbally decline recording and ask for confirmation that the recording has been stopped. You’re also free to end the call or ask for another communication method.

Call recordings may be used for quality assurance, training, follow-up accuracy, dispute resolution, and improving our services.

8. Intellectual Property

Unless otherwise noted, the To Exceed website and its original content are owned by To Exceed or used with permission.

This includes:

  • Website copy;
  • Graphics;
  • Layouts;
  • Blog posts;
  • Case studies;
  • Reports;
  • Downloadable materials;
  • Videos;
  • Podcast materials;
  • Service descriptions;
  • Marketing frameworks;
  • Original designs;
  • Branding and trade dress.

You may view the website for ordinary business evaluation purposes.

You may not copy, scrape, republish, sell, distribute, modify, imitate, or use To Exceed materials to market or train competing services without permission.

You also may not use automated tools to scrape the site, harvest content, build competing datasets, train models, or repackage our work as your own.

We realize this paragraph may be ignored by the exact people it is written for. Still, there it is.

9. AI-Generated Images, Open-Source Photos, and Third-Party Materials

Some images, graphics, or visual elements on the To Exceed website may be generated with artificial intelligence. To the extent those materials are not protected by copyright, To Exceed may still use them as part of the website design, branding, layout, and marketing presentation.

Some photos or visual assets may come from open-source or stock-photo sources. Where practical, open-source photo references may be noted in filenames, meta data, project files, or internal records.

Third-party logos, trademarks, and product names may appear on the website for clarity when discussing platforms or services such as Google, Facebook, LinkedIn, YouTube, Microsoft, or similar products.

Use of those names or logos does not imply that To Exceed is endorsed by, sponsored by, formally partnered with, or officially affiliated with those companies unless we clearly say so.

All third-party trademarks remain the property of their respective owners.

10. Case Studies and Examples

Case studies, examples, charts, testimonials, screenshots, and performance references are provided to illustrate specific situations.

They should not be read as a promise that another company will achieve the same results.

Results vary based on campaign setup, budget, market, competition, hiring process, recruiter responsiveness, job offer, seasonality, tracking accuracy, and other factors.

When we use anonymized or generalized examples, details may be modified to protect client confidentiality or simplify the explanation.

11. Third-Party Links and Embedded Content

The To Exceed website may include links to or embedded content from third-party websites and platforms, including:

  • Google;
  • Facebook;
  • LinkedIn;
  • YouTube;
  • Podcast platforms;
  • Scheduling tools;
  • Client websites;
  • Outside articles, tools, reports, or resources.

Third-party sites and platforms are not controlled by To Exceed. Their content, privacy practices, terms, tracking, availability, and security are their own responsibility.

A link does not mean we endorse every statement, product, service, policy, or practice on that third-party site.

12. Website Availability

We try to keep the website available and accurate, but we do not guarantee that the site will always be available, uninterrupted, error-free, secure, or fully up to date.

We may update, remove, revise, or discontinue website content at any time.

13. User Conduct

You agree not to use the website to:

  • Violate any applicable law;
  • Submit false or misleading information;
  • Attempt unauthorized access to our systems;
  • Interfere with website security or functionality;
  • Scrape or harvest content without permission;
  • Upload malicious code;
  • Impersonate another person or company;
  • Misuse our contact forms;
  • Spam, harass, or abuse To Exceed team members or clients;
  • Copy or repurpose our content to market competing services.

14. No Guaranteed Results

To Exceed may discuss strategies intended to improve marketing efficiency, lead quality, tracking, cost per lead, cost per hire, recruiting outcomes, or related business metrics.

However, we do not guarantee any particular:

  • Lead volume;
  • Cost per lead;
  • Cost per hire;
  • Conversion rate;
  • Hiring result;
  • Revenue result;
  • Advertising platform approval;
  • Search ranking;
  • Social media reach;
  • Return on investment.

Any paid engagement with To Exceed will be governed by the applicable proposal, service agreement, statement of work, or other written contract.

15. Limitation of Liability

To the fullest extent permitted by law, To Exceed is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of the website, reliance on website content, or inability to access the website.

This limitation does not limit rights that cannot legally be limited.

16. Indemnity

If you misuse the website, violate these Terms, submit unlawful content, infringe another party’s rights, or use To Exceed materials without permission, you agree to be responsible for resulting claims, damages, losses, costs, and expenses to the extent permitted by law.

17. Plain-English Dispute Section

If there is a problem, please contact us first so we can try to resolve it directly.

To Exceed is based in Louisiana. These Terms are primarily governed by the laws of Louisiana, without regard to conflict-of-law rules.

Because To Exceed works with businesses across the contiguous United States, applicable federal law and applicable state laws may also apply depending on the situation.

Before either side starts formal legal action, both sides agree to make a reasonable good-faith effort to resolve the dispute informally.

Nothing in this section limits rights that cannot legally be limited.

18. Changes to These Terms

We may update these Terms & Conditions from time to time.

The current version will be posted on this page with an updated “Last Updated” date. You should return to this page periodically to review the current version.

Continued use of the website after changes are posted means you accept the updated Terms.
